Will: Direction for the distribution of your property and the appointment of a guardian for your minor children upon your death.
Codicil: Amendment to an existing Will when minor changes are being made.
If you do not have a valid will at the time of your death, then your property will be distributed according to the Intestate Succession Act.
Mabbott & Company can provide you with the following documents that deal with your property and personal affairs during your lifetime:
Power of Attorney: gives authority to a person that you select to act on your behalf as set out in the documents.
Enduring Power of Attorney: gives authority to a person that you choose to manage your financial affairs even if you become mentally incapacitated. An Enduring Power of Attorney can take effect either when it is executed OR it can take effect if, and only if, at some time in the future you become mentally incapable of managing your affairs.
Personal Directive: gives authority to a person that you choose to make personal and medical decisions on your behalf. A Personal Directive takes effect only if at some time in the future, you become mentally incapable of managing your affairs.
If a person becomes mentally incapable of making personal decisions or managing his/her financial affairs and has not executed an Enduring Power of Attorney or a Personal Directive, then a Court application would be required to have a Trustee and Guardian appointed pursuant to the Adult Guardianship and Trusteeship Act.

Notary Public
Notary Public has the power to administer oaths and take and receive affidavits, declarations and affirmations, just as a Commissioner for Oaths can.
A Notary Public may do several things that a Commissioner cannot. A Notary Public may deal with documents that will be used outside of Alberta (for example, an affidavit to be used in a lawsuit being conducted in the United States or other provinces). A Notary can certify true copies of original documents (we must see the original document). A Notary also has the power to issue certificates under the Guarantees Acknowledgment Act. Each of our lawyers is a Notary Public. Please call to ensure a lawyer will be available to meet with you. Please bring photo identification such as a drivers licence or passport with you.
